EPFO issued the notification dated 17-08-2022 regarding the settlement of pension claims of seasonal workers of seasonal factories/establishments. Fraction of service of the employee for six months or more shall be treated as one year and service of less than six months will be treated as zero.

ESIC issued the notification mentioning to all the employers (Principal employers & Contractors) that it is mandatory to submit the contribution of all engaged employees including temporary/contractual/or enrollment through the contractor.
ESIC is receiving various complaints from employees regarding the non-submission of their contributions. It is the duty of contractors to register all employees on the portal and payment of contributions from the Employer. Non-compliance can land contractors and employers in trouble. EPFO issued the notification on dated 27th April 2022 regarding the declaration of Contractors and Principal Employers on PF portal. EPFO issued the notification on dated 03-06-2022 declaring the credit interest @8.10% for the year of 2021-2022 to the account of each member of the EPF scheme .
The lowest interest since 1977-1978 when it was 8%. For the FY 2020-2021 it was the 8.5% as per the previous year 2019-2020.Download Notification
As per the new notification issued on 07.03.2022 that an insured woman who availed the maternity benefit, need not to pay 70 days of contribution to become eligible for sickness benefit in the mentioned benefit period.

As per the EPFO release payroll data dated 20th Feb 2022, it mentioned that 14.60lakhs employees joined the EPFO in the month of Dec 21 increase of 2.06lakhs as compared to previous year data. Out of 14.60lakhs employees 9.11lakhs new employees enrolled under EPF Act for first time and 5.49lakhs had rejoined EPFO. Establishments covered in Maharashtra, Haryana, Tamil Nadu, Karnataka and Gujarat has employed around 61.44% of total payroll data.

As per the EPFO data, it was noticed that out of total pensioners 66.76 lakhs only 54.84 lakhs have registered online on website of Digital Life Certificate (DLC) for availing pension. DLC have rejected the 0.28 lakhs pensioners application and 14.78 lakhs pensioners have not registered on website till date for pension whereas the procedure was introduced in September 2014 by the government.
So, EPFO has instructed all the regional offices to complete due registration of pensioners on website at earliest by coordinating with Banks, Enforcement Officers and Common Service Centers for the same.Download Notification
Earlier Pensioners were required to submit the Life Certificate at PF office in month of November every year so they can continue the pension which led to heavy workload at PF offices in November month. So, it has been decided that submission of Life certificate in November month ofÂ every year has replaced by it.Now, Pensioners can submit the Life certificate at any time which will be valid for every year from last date of submission.

ESIC issued the notification for Employers who are not satisfied with the order referred to Section 45A can appeal to Appellate Authority after depositing twenty-five percent of the ordered contribution within 60 days of the date of such notice.

It is also extended for the Classes of establishments- Beedi making, Building and Construction and Plantation industries.
For areas and industries/class of establishments other than above, there is no relaxation however delay in filing of ECRs for wage months of August 2021 & September 2021 only in respect of EPF members due to non-seeding of Aadhaar in the UANs should not be presumed for levy of penal damages u/s 14B of the EPF & MP Act, 1952.

Haryana Labor Welfare Board published the notification regarding the Financial Assistance and Funeral Expenses and other dependents benefit schemes in which providing Rs 2, 15,000 to the dependant and Widow of the deceased Employee.
It is applicable to the registered employee in the commercial or industrial establishment in Haryana who died due to any reason of death included Covid-19.
ESIC issued the guidelines to the ESIC Regional offices regarding ESIC Covid-19 Relief Scheme. This Scheme will provide help to the families of the IPs who died due to Covid-19. The eligible dependent family members of IP will be paid periodic payments directly to the Bank account.
The main highlighted points are below:-
â€¢ This Scheme is effective for a period of two years w.e.f 24-03-2020.
â€¢ Employee must be registered before on the ESIC portal at least three months prior to the date of diagnosis of Covid-19 disease resulting in his/her death.
â€¢ Contribution must be deposited for at least 70 days during a period of maximum 1 year immediately preceding the diagnosis of Covid-19 disease resulting in death.
â€¢ 90% of the average daily wages of the deceased IP will be considered for relief.
â€¢ The minimum relief under the scheme shall be Rs.1800/- per month.
â€¢ All claims will be settled within 15 days of receipt of the complete claim.
â€¢ The spouse of the deceased IP shall be eligible for medical care as provided to the widow of a deceased IP who died due to employment injury on depositing Rs.120/- lump-sum for one year.
EPFO allowed the PF members to avail second non-refundable Covid-19 Advance as per The Press Information Bureau Notification on dated 31-05-2021.
Under this provision, non-refundable withdrawal to the extent of the basic wages and dearness allowances for three months or up to 75% of the amount standing to member's credit in the EPF account, whichever is less, is provided. Members can apply for a lesser amount also.
No relief to the Employee and Employer in seeding Aadhar with UAN as per EPF office order dated 01-06-2021.
Section 142 of the code on the Social Security, 2020 is applied to the EPF and ESIC also. ESIC has given relaxation till the update of the existing modules is done whereas EPF had uploaded the Notice on the PF portal to update the Aadhar of the employees to submit their contribution.
It was supposed that EPF would also give relaxation due to lockdown restriction in most states during Covid 19 second waves but EPFO â€‹issued the order to the Regional offices â€‹â€‹to make it apply completely and aware the Employer and Employee to update Aadhar KYC.
ESIC Published the Notification regarding the implementation of section 142 of the Code on Social Security, 2020 on dated 20-05-2021.
ESIC made clear that Aadhar is not mandatory to avail services, seeking benefits and receiving payment in the existing ESIC Act 1948. No insured person shall be denied any benefit in absence of Aadhar.
Although, ESIC is working to change the existing modules as per the requirement of Section 142. Once the changes are completed, ESIC will issue a separate Circular/Notification in this regard and the collection of Aadhar data of Insured persons/beneficiaries will be started.Â Â

All the Principal employers employing the workers through outsourcing are required to mandatory registration with the Labour Department through the e-district portal of Govt of Delhi.
(ISMW) The Inter-State Migrant Workmen Act, 1979 is applicable to every establishment in which five or more Inter-State workmen are employed.
ESIC provided relief to Employee and their Family members during Covid-19
ESIC took the Step to provide the relief of Medical and cash benefit to the Insured IP and their Family members During COVID-19 Pandemic.
In Medical grounds:-
1. The IP and their family can avail free of cost medical care in ESIC/ESIS hospitals declared as Covid-19 dedicated hospitals.
2. ESI Hospital to manage a minimum 20% of its bed capacity as dedicated Covid Beds.
3. Plasma therapy also available in ESIC medical college of Faridabad (Haryana) and Sanath Nagar (Telangana).
4. Option to choose tie-up hospital without referral in Emergency condition.
5. The reimbursement of expenditure may be claimed if treatment taken from private institutions due to infection of covid-19.
In Cash Benefit grounds:-
1. IP can claim sickness benefits for his period of abstention.
2. In unemployed condition, IP may submit the claim for ABVKY Scheme.
3. In unemployed condition due to closure or retrenchment, IP may submit a claim for the RGSKY scheme.
4. ESIC to give funeral expenses of Rs.15000/-, in the event of unfortunate demise of any IP.
However, some reliefs were already available subject to qualifying conditions under ESIC Act.
Section 142 of the Code on Social Security, 2020 has been made applicable w.e.f 03-05-2021.
are many sub-sections that have been included for the registration of all the
employees, organized or non-organized workers in any sector or field. It will
help to create a database of all on the Government portal to make them benefit
from all social security benefits under Government law and Acts.
Now, Aadhar has been made mandatory to avail benefits under all the socialÂ security schemes.
Amendment in Finance Bill, 2021 is
approved and Gazette was published on dated 28-03-2021.
The provisions of Finance Bill,
2021 relating to direct taxes amended the Income-tax Act, 1961. The amendment
in Section 36 and 43B of Income Tax Act, 1961 leads that if any Employer Pay
the Contribution Challan of PF, ESIC, LWF etc. after Due date. In this case,
The Employer will not be eligible to book the paid amount in Business Expenses.
The amendment in clause (11) and
Clause (12) under Section 10 of Income Tax Act, 1961. Tax will be counted on PF
Interest if Employee PF contribution is deposited exceeding Rupees Five Lakh
It will definitely affect the Employee contributing VPF above Five lakh Rupees.
The Delhi government declared to give medical assistance of Rs 10,000/- to the construction worker and their family member if found positive with the Covid-19 disease.
It will be disbursed at the rate of Rs.5,000/- ,
subject to a maximum of Rs.10,000/- per family. The process to claim this
disbursal is fair and simple, a member of the family would have to produce an
RT-PCR report, which will then be verified through the ICMR portal.
EPFO issued the Gazette Notification regarding the maximum assurance benefit payable under EDLI Scheme has been enhanced to Rs. 7 lakh from the earlier maximum benefit of Rs. 6 lakh.
The minimum assurance benefit has been fixed at Rs.2.50 lakh.
The Monetary fine payable has been enhanced to Rs.25000/-.Download Notification
