ESIC is allowed to perform Aadhaar Authentication.

Ministry of Labour & Department issued the notification dated 13-01-2023 allowed the ESIC to perform the aadhar authentication on voluntary basis with the “Yes or No” or eKYC facility to provide the social security benefits (medical and cash benefits).

This notification shall come into force on date of its publication in the Official Gazette.

Filing of ESIC Contributions whereas employees are on leave.

ESIC issued the notification dated 19-01-2023, mentioning that by mistake of employers/consultants many cases are noticing in which contributions are submitting of employees whereas they were on leave.

Therefore, to avoid the recovery of wages paid to employees by the ESIC during the leave period, carefully file the contribution on the portal otherwise, legal action will be taken against by the ESIC under the ESIC Act 1948.

Online Claim Request For Maternity Benefits For Insured Women.

With reference to previous notifications dated 22-09-2022 & 19-11-2022, ESIC Deputy Dir. issued the notification dated 03-01-2023 instructing all ROs/SROs to spread awareness for submission of online claim for maternity benefits of Insured Women through the online portal by IP/Employer as through online portal less cases are noticing.

Immediate due payment release of EDLI amount to Family Members.

EPFO issued the notification dated 02-01-2023 regarding the release of the due payment of EDLI amount to family members of deceased members as per the Gazetted notification.

With dated 15-02-2018 provision of minimum assurance benefits of Rs-2.5lakhs was introduced to EDLI by EPFO. Recently it has been noticed that in some cases of death of employees their nominees are not receiving the stimulated calculated amount as per the EDLI scheme.

Therefore, all ZOs are directed that there will be no delay for disbursing the accurate EDLI amount to the nominees.

Several Pending Requests of IPs on ESIC portal (Edit/Update Details).

ESIC issued the notification dated 06-12-2022  which it has been conveyed that an online module for updation/editing particulars of IP and their family members has been developed by ICT Branch.

As per the records the pending requests are not getting approved timely and employees are facing problems so, ESIC has directed the ROs/SROs/field offices to dispose of all pending requests for updation of details within 3 days of request generated by the Employer on the portal.

Deputy Director-Website Contents issued the notification dated 7-12-2022 to inform that Domain Name of ESIC websites www.esic.nic.in and www.esic.in have been changed to www.esic.gov.in . Settlement of Pension Claims Related to Seasonal workers/establishments

EPFO issued the notification dated 17-08-2022 regarding the settlement of pension claims of seasonal workers of seasonal factories/establishments. Fraction of service of the employee for six months or more shall be treated as one year and service of less than six months will be treated as zero.

In case of a seasonally employed employee worked in any establishment period of contributory service of less than one year will such service shall be treated as a full year .

SOP Introduced by EPFO for settling of Death Claims (Industrial Accident)

EPFO issued the notification dated 03-08-2022 regarding the framed of SOP (Standard Operational Procedure) for settling of the claims on the top priority in case of death of the member by Industrial Accident.
Immediate process should be followed in case of Industrial Accident Death so that family members/nominee can avail the benefits from EPFO and delay in such action will be treated as violation under provision of EPF Act 1952 and shall be liable for action as per law.

Mandatory Submission of ESIC contribution of Employees.

ESIC issued the notification mentioning to all the employers (Principal employers & Contractors) that it is mandatory to submit the contribution of all engaged employees including temporary/contractual/or enrollment through the contractor.

ESIC is receiving various complaints from employees regarding the non-submission of their contributions. It is the duty of contractors to register all employees on the portal and payment of contributions from the Employer. Non-compliance can land contractors and employers in trouble. Legal action can also be taken against them under ESIC Act 1948 for violation of the above provisions.

ESIC Settlement of Re-imbursement Bills within 30 days of time.

ESIC issued the notification dated 25-04-2022 regarding the settlement of medical re-imbursement of the insured persons. Competent Authority had given the financial power to the SRO to settle/pass the bill up to Rs-50,000/- and amount can be transferred to Insured person’s account.

The Authority directed SRO to sign on the document containing the list of bills only, there is no need to sign every page of list. This will help in reducing the patient’s problem and in improving the ESIC image.

Options for Declaration of Principal Employers/Contractors on PF Portal

EPFO issued the notification on dated 27th April 2022 regarding the declaration of Contractors and Principal Employers on PF portal. Both have to registered the details of each other in their specified option on portal. Now, principal employers can manage the whole activity of contractors (nature of work//man power/challan submission). Separate license will issued to contractor in every contract including the Principal Employer details.

This will ease the work of compliances for both and as well as for the PF office also. EPFO issued the format also for Principal Employers regarding (disclosing the details of Contractors).

Remitting of Pension Share for Employees after 58 Years also.

EPFO issued the notification on 22nd April 2022 for making aware to employers as many employers are submitting the contribution of those employees also who have attained the 58 years of age which is not applicable as per EPF act. Due to this at time of applying for full and final settlement employees are facing problems as their claims are get rejecting and EPFO offices to put lot of effort to correct the same mistakes..

Employers need to be more cautious while uploading the ECR on portal as EPFO has already provided the option to verify the employees who has attained the 58 years of age before submitting the challan.

EPFO Rate of Interest FY 2021-2022 @8.10%.

EPFO issued the notification on dated 03-06-2022 declaring the credit interest @8.10% for the year of 2021-2022 to the account of each member of the EPF scheme .

The lowest interest since 1977-1978 when it was 8%. For the FY 2020-2021 it was the 8.5% as per the previous year 2019-2020.

Amendment in the ESIC Rule 55 (Maternity Sickness Benefit).

As per the new notification issued on 07.03.2022 that an insured woman who availed the maternity benefit, need not to pay 70 days of contribution to become eligible for sickness benefit in the mentioned benefit period.

 Now, as per amendment she has to contribute only half number of days in the relevant contribution period.

All Covid Restrictions has been removed in NCT of Delhi by DDMA.

DDMA issued the notification dt.26.02.2022 regarding this, the decision taken in the meeting held on 25.2.2022 under the chairmanship of Hon’ble Lt. Governor on the basis of occupancy of covid beds in hospitals and on basis of vastly improvement in covid situation. All restrictions will be violated w.e.f 28th February 00.00hrs.

Addition of 14.60Lakhs Employees on EPFO during December 2021.

As per the EPFO release payroll data dated 20th Feb 2022, it mentioned that 14.60lakhs employees joined the EPFO in the month of Dec 21 increase of 2.06lakhs  as compared to previous year data. Out of 14.60lakhs employees 9.11lakhs new employees enrolled under EPF Act for first time and 5.49lakhs had rejoined EPFO. Establishments covered in Maharashtra, Haryana, Tamil Nadu, Karnataka and Gujarat has employed around 61.44% of total payroll data.

EPFO provides benefits to the employees as well as for family members like pension benefit at time of retirement and insurance benefits in case of untimely death of a member.

Incomplete registration of Digital Life Certificates - Pensioners

As per the EPFO data, it was noticed that out of total pensioners 66.76 lakhs only 54.84 lakhs have registered online on website of Digital Life Certificate (DLC) for availing pension. DLC have rejected the 0.28 lakhs pensioners application and 14.78 lakhs pensioners have not registered on website till date for pension whereas the procedure was introduced in September 2014 by the government.

So, EPFO has instructed all the regional offices to complete due registration of pensioners on website at earliest by coordinating with Banks, Enforcement Officers and Common Service Centers for the same.

Now, EPF Pensioner Can Submit Life Certificate At Any Time

Earlier Pensioners were required to submit the Life Certificate at PF office in month of November every year so they can continue the pension which led to heavy workload at PF offices in November month. So, it has been decided that submission of Life certificate in November month of  every year has replaced by it.

Now, Pensioners can submit the Life certificate at any time which will be valid for every year from last date of submission.

ESIC issued notification for employers can appeal to odered Section 45A

ESIC issued the notification for Employers who are not satisfied with the order referred to Section 45A can appeal to Appellate Authority after depositing twenty-five percent of the ordered contribution within 60 days of the date of such notice.

EPFO extended the deadline for seeding of UAN with Aadhar till December 2021

The EPFO issued the notification regarding the extension of the deadline for Seeding of UAN with Aadhar from the earlier date 1st September 2021 to 31st December 2021 for the North East Region comprising of States of Assam, Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland & Tripura on dated 11/09/2021.
It is also extended for the Classes of establishments- Beedi making, Building and Construction and Plantation industries.
For areas and industries/class of establishments other than above, there is no relaxation however delay in filing of ECRs for wage months of August 2021 & September 2021 only in respect of EPF members due to non-seeding of Aadhaar in the UANs should not be presumed for levy of penal damages u/s 14B of the EPF & MP Act, 1952.

HARYANA LABOUR WELFARE BOARD

Haryana Labor Welfare Board published the notification regarding the Financial Assistance and Funeral Expenses and other dependents benefit schemes in which providing Rs 2, 15,000 to the dependant and Widow of the deceased Employee.
It is applicable to the registered employee in the commercial or industrial establishment in Haryana who died due to any reason of death included Covid-19.

Delhi Minimum Wages w.e.f 01-04-2021

Delhi Minimum Wages has been Revised and Notification issued on dated 18-06-2021. It is effective w.e.f 01-04-2021.
The employer has to pay arrear for the period April 2021 to May 2021 to comply with the revised Minimum Wages.

The date of implementation has been extended from 01-06-2021 to 01-09-2021. Now, the Employer can generate Challan without linking/seeding of Aadhar till 31-08-2021.

EMPLOYEE STATE INSURANCE ACT, 1948

ESIC issued the guidelines to the ESIC Regional offices regarding ESIC Covid-19 Relief Scheme. This Scheme will provide help to the families of the IPs who died due to Covid-19. The eligible dependent family members of IP will be paid periodic payments directly to the Bank account.
The main highlighted points are below:-
• This Scheme is effective for a period of two years w.e.f 24-03-2020.
• Employee must be registered before on the ESIC portal at least three months prior to the date of diagnosis of Covid-19 disease resulting in his/her death.
• Contribution must be deposited for at least 70 days during a period of maximum 1 year immediately preceding the diagnosis of Covid-19 disease resulting in death.
• 90% of the average daily wages of the deceased IP will be considered for relief.
• The minimum relief under the scheme shall be Rs.1800/- per month.
• All claims will be settled within 15 days of receipt of the complete claim.
• The spouse of the deceased IP shall be eligible for medical care as provided to the widow of a deceased IP who died due to employment injury on depositing Rs.120/- lump-sum for one year.

EPFO allowed the PF members to avail second non-refundable Covid-19 Advance as per The Press Information Bureau Notification on dated 31-05-2021.
Under this provision, non-refundable withdrawal to the extent of the basic wages and dearness allowances for three months or up to 75% of the amount standing to member's credit in the EPF account, whichever is less, is provided. Members can apply for a lesser amount also.

No relief to the Employee and Employer in seeding Aadhar with UAN as per EPF office order dated 01-06-2021.
Section 142 of the code on the Social Security, 2020 is applied to the EPF and ESIC also. ESIC has given relaxation till the update of the existing modules is done whereas EPF had uploaded the Notice on the PF portal to update the Aadhar of the employees to submit their contribution.
It was supposed that EPF would also give relaxation due to lockdown restriction in most states during Covid 19 second waves but EPFO ​issued the order to the Regional offices ​​to make it apply completely and aware the Employer and Employee to update Aadhar KYC.

EMPLOYEE STATE INSURANCE ACT, 1948

ESIC Published the Notification regarding the implementation of section 142 of the Code on Social Security, 2020 on dated 20-05-2021.
ESIC made clear that Aadhar is not mandatory to avail services, seeking benefits and receiving payment in the existing ESIC Act 1948. No insured person shall be denied any benefit in absence of Aadhar.
Although, ESIC is working to change the existing modules as per the requirement of Section 142. Once the changes are completed, ESIC will issue a separate Circular/Notification in this regard and the collection of Aadhar data of Insured persons/beneficiaries will be started.

As per the circular of Labour Department, Govt. of Delhi on dated 14-05-2021.
All the Principal employers employing the workers through outsourcing are required to mandatory registration with the Labour Department through the e-district portal of Govt of Delhi.
(ISMW) The Inter-State Migrant Workmen Act, 1979 is applicable to every establishment in which five or more Inter-State workmen are employed.

ESIC provided relief to Employee and their Family members during Covid-19
ESIC took the Step to provide the relief of Medical and cash benefit to the Insured IP and their Family members During COVID-19 Pandemic.

In Medical grounds:-

1. The IP and their family can avail free of cost medical care in ESIC/ESIS hospitals declared as Covid-19 dedicated hospitals.
2. ESI Hospital to manage a minimum 20% of its bed capacity as dedicated Covid Beds.
3. Plasma therapy also available in ESIC medical college of Faridabad (Haryana) and Sanath Nagar (Telangana).
4. Option to choose tie-up hospital without referral in Emergency condition.
5. The reimbursement of expenditure may be claimed if treatment taken from private institutions due to infection of covid-19.

In Cash Benefit grounds:-

1. IP can claim sickness benefits for his period of abstention.
2. In unemployed condition, IP may submit the claim for ABVKY Scheme.
3. In unemployed condition due to closure or retrenchment, IP may submit a claim for the RGSKY scheme.
4. ESIC to give funeral expenses of Rs.15000/-, in the event of unfortunate demise of any IP.

However, some reliefs were already available subject to qualifying conditions under ESIC Act.

THE CODE ON SOCIAL SECURITY ACT, 2020

Section 142 of the Code on Social Security, 2020 has been made applicable w.e.f 03-05-2021.
There are many sub-sections that have been included for the registration of all the employees, organized or non-organized workers in any sector or field. It will help to create a database of all on the Government portal to make them benefit from all social security benefits under Government law and Acts.
Now, Aadhar has been made mandatory to avail benefits under all the social security schemes.

AMENDMENT IN FINANCE BILL, 2021

Amendment in Finance Bill, 2021 is approved and Gazette was published on dated 28-03-2021.
The provisions of Finance Bill, 2021 relating to direct taxes amended the Income-tax Act, 1961. The amendment in Section 36 and 43B of Income Tax Act, 1961 leads that if any Employer Pay the Contribution Challan of PF, ESIC, LWF etc. after Due date. In this case, The Employer will not be eligible to book the paid amount in Business Expenses.

The amendment in clause (11) and Clause (12) under Section 10 of Income Tax Act, 1961. Tax will be counted on PF Interest if Employee PF contribution is deposited exceeding Rupees Five Lakh only.

It will definitely affect the Employee contributing VPF above Five lakh Rupees.

BUILDING AND OTHER CONSTRUCTIONS WORKERS ACT, 1996

The Delhi government declared to give medical assistance of Rs 10,000/- to the construction worker and their family member if found positive with the Covid-19 disease.

It will be disbursed at the rate of Rs.5,000/- , subject to a maximum of Rs.10,000/- per family. The process to claim this disbursal is fair and simple, a member of the family would have to produce an RT-PCR report, which will then be verified through the ICMR portal.

The minimum assurance benefit has been fixed at Rs.2.50 lakh.

The Monetary fine payable has been enhanced to Rs.25000/-.

CCA - DISCONTINUED ISSUANCE OF CLASS II DSC W.E.F 01-01-2021

On November 26, 2020, a Controller of Certifying Authorities (CCA) revised the issue of Class II DSCs. The CAA agreed to discontinue the issuance of Class II DSC effective January 1, 2021.
The guideline notes that Class III DSC would replace Class II DSC for all purposes, including Income Tax, PF, GST, ROC filing, Tenders, etc. Highlights of CCA New Updated:-
1. No class II DSC to be issued and only class III DSC will be issued from 01st Jan 2021.
2. From January 1st, 2021 all organization DSC’s will only be in paperless mode and organization DSC’s in paper mode cannot be issued by any Certifying Authority.
3. Even for DSC’s for Government officials, video verification is made mandatory effective January 1st, 2021. Download Complete Notification.

Relaxation In Eligibility Criteria And Enhancement In The Payment Of Unemployment Benefit Under Atal Bimit Vyakti Kalyan Yojana Of ESIC.
The ESIC has now decided to extend the scheme for one more year up to 30th June 2021. It has been decided to relax the existing conditions and enhance the amount of relief for workers who have lost employment during the Covid-19 pandemic period. The enhanced relief under the relaxed conditions will be payable during the period of 24th March 2020 to 31st December 2020

EPFO published the Circular for Settlement Of Death Claims on Priority Basis EPFO vide circular no EDLI/3(39)SOM/2020/246 has directed the Regional Provident Fund Commissioner (in-charge of Regions) to depute an Enforcement Officer towards ascertainment of complete details of any incidents of industrial accidents resulting in the death of employees of a covered establishment as well as ensuring due to guidance provided to family members/legal beneficiaries of the deceased members by the filing of claims.

Extension Of Validity Period Of Scheme under PMGKY
The extension has been done of Validity Period Of Scheme under PMGKY Package To 24% Contribution For Employer And Employee As per the notification to prevent disruption in the employment of low wage-earning employees and support establishments employing up to one hundred employees, the entire employees EPF contributions (12% of wages) and employers’ EPF & EPS contribution (12% of wages), totaling 24% of the monthly wages for the next three months that is June, July, August shall be directly paid by the Central Govt. in the EPF accounts (UAN) of employees, who are already members of Employees Provident Funds Scheme,1952, drawing wages less than fifteen thousand rupees per month and employed in establishments, already covered under the Employees Provident Funds And Miscellaneous Provisions Act 1952.
